Terms of Service

1. Acceptance of Terms
By accessing or using the Kinecto service, mobile application, or website (collectively, the "Service") operated by Kinecto AI ("Kinecto," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Kinecto provides an AI-powered calling service that places phone calls to elderly individuals on behalf of their family members. The Service includes:
- Automated AI phone calls to registered elderly users
- Call scheduling and management
- Post-call summaries and mood tracking
- Family updates and communication tools
- Treasured Memories audio highlights
- Loneliness detection and alerting
- Push and email notifications for call updates, wellbeing alerts, and account activity
- Data export and account management
- Two-factor authentication for account security
- Facility dashboards with aggregate wellness and amenity/event sentiment insights
- Facility-initiated invitations for family onboarding
The Service uses artificial intelligence for conversations and is not a substitute for human interaction, medical care, emergency services, or professional caregiving.
3. Account Registration
- You must be at least 18 years old to create an account
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized use of your account
- One account per person; you may not create accounts for others without their knowledge
4. Consent for Elderly Users
When registering an elderly user for calls, you represent and warrant that:
- You have the legal authority to act on their behalf, or you have informed them about the service
- You understand that Kinecto will ask your loved one for verbal consent during the first call
- If your loved one declines consent, no further calls will be placed
- You will respect the elderly user's right to revoke consent at any time
Kinecto will not continue calling any individual who has declined or revoked consent.
5. Subscriptions and Payments
5.1 Plans and Pricing
The Service is offered through subscription plans with varying features and pricing. Current plans and pricing are displayed in the app and on our website. Prices are in US dollars and do not include applicable taxes.
5.2 Facility Billing
Senior living facilities may subscribe on a seat-based pricing model, covering call services for their residents. When a facility covers a resident, the family member does not need their own subscription for that resident. Facility billing terms are governed by the facility service agreement.
5.3 Billing
- Subscriptions are billed monthly through Stripe
- Payment is charged at the start of each billing period
- You authorize us to charge your payment method for recurring subscription fees
5.4 Cancellation
- You may cancel your subscription at any time through the app (Settings → Subscription)
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for partial billing periods
- Scheduled calls will continue until the end of the paid period
5.5 Price Changes
We may change subscription prices with 30 days' written notice. Continued use after the price change constitutes acceptance of the new pricing.
6. Notifications
By using the Service, you consent to receiving notifications related to the Service, including:
- Call summaries, wellbeing alerts, and consent updates via email and push notifications
- Subscription and billing notifications
- Facility-related updates (if linked to a senior living community)
You can manage your notification preferences in the app under Settings → Notifications. Certain critical notifications (consent changes, security alerts) cannot be disabled.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Register elderly users without their knowledge or consent
- Attempt to bypass security measures or access other users' data
- Interfere with or disrupt the Service infrastructure
- Use the Service to harass, abuse, or harm any person
- Share your account credentials with others
- Use the Service as a substitute for emergency services (call 911 for emergencies)
- Reverse engineer, decompile, or attempt to extract the source code of the Service
8. Content and Intellectual Property
8.1 Your Content
You retain ownership of content you submit (family updates, photos, feedback). By submitting content, you grant Kinecto a limited license to use it for providing the Service (e.g., sharing your updates during calls).
8.2 Our Content
The Service, including its software, design, features, documentation, and AI-generated content, is owned by Kinecto and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
8.3 AI-Generated Content
Call summaries, mood analysis, amenity/event sentiment insights, and Treasured Memories highlights are generated by AI. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. These outputs are provided for informational purposes and should not be relied upon as medical or professional advice.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.
10. Disclaimers
- The Service is provided "as is" and "as available" without warranties of any kind
- Kinecto is not a medical device, healthcare provider, or emergency service
- We do not guarantee that calls will be placed at exact scheduled times (minor variations may occur)
- AI conversations may occasionally misunderstand or provide inaccurate responses
- Mood and loneliness assessments are AI-generated indicators, not clinical diagnoses
- We do not guarantee uninterrupted or error-free operation of the Service
11. Limitation of Liability
To the maximum extent permitted by law, Kinecto and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:
- Emotional distress arising from AI-generated conversation content
- Failure to detect health emergencies or changes in wellbeing
- Service interruptions or missed scheduled calls
- Inaccuracies in AI-generated summaries or mood assessments
- Loss of data or unauthorized access to your account
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Kinecto from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third party's rights.
13. Termination
- You may terminate your account at any time through the app (Settings → Privacy & Security → Delete Account) or by contacting support
- We may suspend or terminate your account for violation of these Terms, with notice where practicable
- Upon termination, your right to use the Service ceases immediately
- We will delete your data in accordance with our Privacy Policy and applicable data retention requirements
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Texas.
